WOOLWORTHS EXCLUSIVE BIOZET PROMOTION
HOW TO ENTER
To be eligible to enter, consumers must purchase any 1.5kg or 2.5kg product from the BiozZet range from any participating Woolworths or Safeway store during the promotional period. To enter, individuals must then complete the official entry form found in-store, including the product barcode and the Woolworths store receipt number and mail the completed official entry form in a stamped envelope to ‘BioZet: Win a Garden Makeover” Promotion, PO Box 689, Eastern Suburbs MC NSW 2004’.
TERMS AND CONDITIONS
Information on how to enter and prizes form part of these Terms and Conditions. Participating in this promotion is deemed acceptance of these Terms and Conditions.
Entry is only open to residents of Australia. Employees (and their immediate families) of the Promoter, participating Woolworths or Safeway stores and their agencies associated with this promotion are ineligible to enter.
The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place of residence) and to disqualify any entrant who tampers with the entry process or who submits an entry that is not in accordance with these Terms and Conditions. Failure of the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights.
Multiple entries are permitted, subject to the following:
(a) only one entry permitted per specified purchase requirement; and
(b) each entry must be submitted separately and in accordance with the entry requirements.
Incomplete, indecipherable or illegible entries will be deemed invalid.
Entrants must retain a photo copy of their original Woolworths or Safeway receipt/s for all entries as proof of purchase. Failure to produce proof of purchase for all entries when requested may in the absolute discretion of the Promoters result in invalidation of all of an entrant’s entries and forfeiture of any right to a prize. Purchase receipt/s must clearly specify the store of purchase, product purchased and that the purchase was made during the promotional period but prior to entry.
Promotion commences 04.08.2008. Entries close last mail received on 31.08.08. The draw will take place at Greeneagle Distribution and Fulfillment, Unit 10, 20 Ricketty Street, Mascot NSW 2020 on 12.09.2008 at 2:00pm AEST. Winners will be notified by mail. The major prize winner will be notified by phone and mail and their name will be published in The Australian on 10.10.2008. The Promoter’s decision is final and no correspondence will be entered into.
The first 3,000 valid entries received will each receive one (1) Fiskars garden trowel & fork set valued at RRP $8.
All valid entries received will be entered in to the major prize draw for the chance to win a garden makeover valued at up to $20,000 or $16,500 cash. The first valid entry drawn from all entries received will win the major prize of either a garden makeover prize, which includes: design consultation with Jody Rigby, drafting of garden plans for proposed changes, all labour, plants & incidentals up to the value of $20,000 or $16,500 cash. The winner and Jody Rigby will, in agreement, determine the proposed changes to the winner’s garden. Garden makeover prize must be taken by June 30, 2009. Any garden makeover costs above $20,000 will be the responsibility of the winner. Garden makeover prize is subject to all applicable government approvals including any council approvals. The winner will receive the $16,500 cash in lieu of the garden makeover if:
(a) the winner does not have a garden;
(b) is not the owner of the garden where they reside; or
(c) cannot obtain appropriate government approvals.
Total prize pool value is up to $44,000. Prizes, or any unused portion of a prize, are not transferable or exchangeable and cannot be taken as cash, unless otherwise agreed to by the Promoter in its absolute discretion.
Iif any prize winners are under the age of 18 the prize will be awarded to the winners nominated parent or guardian.
Prize values are in Australian dollars and include GST.
In the event that a prize is not available despite the Promoter’s reasonable endeavours to provide the prize, the Promoter reserves the right to substitute a prize(s) to the same and equal recommended retail value and/or specification, subject to any written directions from a regulatory authority.
A draw for any unclaimed major prize may take place on 15.12.08 at the same time and place as the original draw, subject to any directions from a regulatory authority. Winner’s name (if necessary) will be published in The Australian on 04/01/09.
If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law
(a) to disqualify any entrant; or
(b) subject to any written directions from a regulatory authority, to modify, suspend, terminate or cancel the promotion, as appropriate.
Except for any liability that cannot be excluded by law, the Promoter (including its officers, employees and agents) excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of the Promotion, including, but not limited to, where arising out of the following:
(a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
(b) any theft, unauthorised access or third party interference;
(c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
(d) any variation in prize value to that stated in these Terms and Conditions;
(e) any tax liability incurred by a winner or entrant; or
(f) use of a prize.
Winners consent to the Promoter using the winner's name, likeness, image and/or voice, in any media for an unlimited period of time without remuneration for the purpose of promoting this competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
The Promoter collects personal information in order to conduct the Promotion and may, for this purpose, disclose such information to third parties, including, but not limited to, prize suppliers and as required, to Australian regulatory authorities. Entry is conditional on providing this information. The Promoter may, for an indefinite period unless otherwise advised, use the information for promotional, marketing and publicity purposes including sending electronic messages or telephoning the entrant. Entrants should direct any request to access, update or correct information to the Promoter at their address set out below. All entries become the property of the Promoter.
